Myth: If I file for bankruptcy, my credit will be ruined for the rest of my life.

Truth: If you cannot pay your bills, your credit is ruined. If you continue to ignore your bills, your credit will continue to be ruined. Filing bankruptcy can resolve your debt issues and allow you to restore your credit. Ironically, it can be a good way to actually begin to rebuild your credit.

Myth: I am going to lose my house.

Truth: Depending on your situation, filing for bankruptcy can freeze any foreclosure actions that may be taken against you. It can give you and your attorney the time you need to sort out what financial steps you can take that may help you save your home. In many situations, our clients are able to keep their homes.

Myth: I can be jailed for failing to pay my credit card debt.

Truth: It is against the law to be put in jail for debt that you owe. There are two exceptions to this rule: lack of payment of child support and tax evasion. If your creditors are threatening you in any way, speak to a lawyer. They may be in violation of the law. Filing for bankruptcy will immediately freeze any creditor actions and put a stop to harassing creditor calls.

Myth: Bankruptcy only happens to deadbeats.

Truth: Tell that to our fixed-income elderly client whose medicine costs $50,000/year and who had to use credit cards to pay for lifesaving medicine but ended up going into credit card debt as a result. Our clients come from all walks of life, all economic backgrounds and each of them has a different situation that brought them to bankruptcy. In fact, people who file for bankruptcy often become more financially responsible and able to better contribute to society once their stress is relieved after filing for bankruptcy.
